Marvel’s Guardians of the Galaxy Vol. 2 is billed as a sci-fi superhero flick, but in one corner of Texas, it’s fodder for a legal drama.
An Austin man is suing his date for texting during a showing of the movie, according to The Austin American-Statesman.
Brandon Vezmar, 37, is taking the unidentified woman he met online to small claims court for the price of her $17.31 ticket to the 3-D screening after what he called “the date from hell.”
During their first date on May 6, Vezmer told the newspaper that the woman “activated her phone at least 10-20 times in 15 minutes to read and send text messages.”
According to Vezmer’s account, she left the theater and never came back when he asked her to take her texting outside. To make matters worse, she drove away, leaving him stranded as she was his ride to the theater.
The woman told the American-Statesman Tuesday that she only texted on her phone in the theater two or three times. “I had my phone low and I wasn’t bothering anybody,” she said, though that’s still a violation of movie theater etiquette.
She’s filing an order of protection against Vezmar for contacting her sister demanding payment.
“I’m not a bad woman,” the woman said. “I just went out on a date.”
